Trump administration sought to enlist intelligence officials, key lawmakers to counter Russia stories



The Trump administration has enlisted senior members of the intelligence community and Congress in efforts to counter news stories about Trump associates’ ties to Russia, a politically charged issue that has been under investigation by the FBI as well as lawmakers now defending the White House.
Acting at the behest of the White House, the officials made calls to news organizations last week in attempts to challenge stories about alleged contacts between members of President Trump’s campaign team and Russian intelligence operatives, U.S. officials said.

The calls were orchestrated by the White House after unsuccessful attempts by the administration to get senior FBI officials to speak with news organizations and dispute the accuracy of stories on the alleged contacts with Russia.

The White House on Friday acknowledged those interactions with the FBI but did not disclose that it then turned to other officials who agreed to do what the FBI would not — participate in White House-arranged calls with news organizations, including The Washington Post.
Two of those officials spoke on the condition of anonymity — a practice President Trump has condemned.

The officials broadly dismissed Trump associates’ contacts with Russia as infrequent and inconsequential. But the officials would not answer substantive questions about the issue, and their comments were not published by The Post and do not appear to have been reported elsewhere.
White House spokesman Sean Spicer confirmed that the White House communicated with officials with the aim of contesting reporting on Russia, but maintained that the administration did nothing improper. “When informed by the FBI that [the ­Russia-related reporting] was false, we told reporters who else they should contact to corroborate the FBI’s version of the story,” he said.

The decision to involve those officials could be perceived as threatening the independence of U.S. spy agencies that are supposed to remain insulated from partisan issues, as well as undercutting the credibility of ongoing congressional probes. Those officials saw their involvement as an attempt to correct coverage they believed to be erroneous.

The effort also involved senior lawmakers with access to classified intelligence about Russia, including Sen. Richard Burr (R-N.C.) and Rep. Devin Nunes (R-Calif.), the chairmen of the Senate and House intelligence committees. A spokesman for Nunes said that he had already begun speaking to reporters to challenge the story and that, “at the request of a White House communications aide, Chairman Nunes then spoke to an additional reporter and delivered the same message.”

Unlike the others, Nunes spoke on the record and was subsequently quoted in the Wall Street Journal.
In an interview, Burr acknowledged that he “had conversations about” Russia-related news reports with the White House and engaged with news organizations to dispute articles by the New York Times and CNN that alleged “repeated” or “constant” contact between Trump campaign members and Russian intelligence operatives.

“I’ve had those conversations,” Burr said, adding that he regarded the contacts as appropriate provided that “I felt I had something to share that didn’t breach my responsibilities to the committee in an ongoing investigation.”

The administration’s push against the Russia coverage intensified Sunday when White House Chief of Staff Reince Priebus said in television interviews that he had been authorized “by the top levels of the intelligence community” to denounce reports on Trump campaign contacts with Russia as false.
Priebus’s denunciations ranged from calling the articles “overstated” to saying they were “complete garbage.”

Administration officials said that Priebus’s comments had been cleared by FBI Director James B. Comey and Deputy Director Andrew McCabe. In doing so, the FBI’s leadership would appear to have been drawing a distinction between authorizing comments by a White House official and addressing the matter themselves.

Rep. Adam B. Schiff (Calif.), the ranking Democrat on the House Intelligence Committee, issued a statement Friday evening saying that if the White House “contrived to have intelligence officials contradict unfavorable news reports, this represents a new and even more grave threat to the independence of the intelligence community.”


Former intelligence officials expressed concern over the blurring of lines between intelligence and politics, with some recalling Republican accusations that the Obama administration had twisted intelligence in its accounts of the 2012 attacks on U.S. facilities in Benghazi, Libya.

“I doubt that there was any enthusiasm from the intelligence leadership to get involved in this in the first place,” former CIA director Michael Hayden said, noting that it seemed unlikely that Priebus’s bluntly worded denials were consistent with the “precise language” favored by intelligence analysts.
“Think Benghazi here,” Hayden said in an interview by email. “This is what happens when the intel guys are leaned on for the narrative of the political speakers. The latter have different rules, words, purposes. Getting intel into that mix always ends unhappily, [and] it looks like we just did.”

The Trump administration’s actions reflect its level of concern about coverage of its relationship with Russia. Trump has continued to praise Russian President Vladimir Putin, even after U.S. intelligence agencies concluded that Russia had interfered in the U.S. presidential race to help Trump win.

Trump has also repeatedly disparaged the intelligence agencies that his administration last week turned to for support. Shortly before taking office, Trump accused U.S. spy agencies of a Nazi-style leaks campaign to smear him.

The White House statements on the issue Friday came after CNN reported that the FBI had refused administration requests to publicly “knock down” media reports about ties between Trump associates and Russian intelligence.
Administration officials disputed the account, saying that rather than soliciting FBI feedback, Priebus had been pulled aside by McCabe on the morning of Feb. 15 and told, “I want you to know” that the New York Times story “is BS.”

The FBI declined to discuss the matter.

White House officials declined to comment on the administration’s subsequent effort to enlist other government officials and would not agree to allow the identification of the intelligence officials who had spoken to The Post last week. In separate calls, those individuals insisted on being identified only as “a senior intelligence official in the Trump administration” and “a senior member of the intelligence community.”

In a brief interview on the night of Feb. 15, the senior intelligence official said that the suggestion that there was frequent contact between Russians and Trump associates was false, describing any conversations as sporadic, limited and based on Russia’s interest in building a relationship with the future Trump administration rather than shaping the 2016 presidential race.

The senior intelligence official appeared to be referring to contacts between Trump’s designated national security adviser, Michael Flynn, and Russian Ambassador Sergey Kislyak before Trump was sworn in as president. Flynn was forced out of his job earlier this month after The Post reported that Flynn had discussed U.S. sanctions against Russia with Kislyak and then misled Trump administration officials about the nature of his contacts.

Officials at the CIA and the Office of the Director of National Intelligence declined to comment on whether senior officials at those agencies had discussed Russia coverage with the White House or been involved in efforts to refute stories on that subject.

CIA Director Mike Pompeo is the senior-most intelligence official in the administration, with former senator Dan Coats (R-Ind.) still awaiting confirmation as director of national intelligence.

As a Republican member of Congress, Pompeo was among the most fiercely partisan figures in the House investigation of Benghazi, which centered on accusations that the Obama administration had twisted intelligence about the attacks for political purposes.

It is not unusual for CIA leaders to have contact with news organizations, particularly about global issues such as terrorism or to contest news accounts of CIA operations. But involving the agency on alleged Trump campaign ties to Russia could be problematic.

The CIA is not in charge of the investigation. Given the history of domestic espionage abuses in the United States, CIA officials are typically averse to being drawn into matters that involve U.S. citizens or might make the agency vulnerable to charges that it is politicizing intelligence.

A U.S. intelligence official declined to discuss any Pompeo involvement except to say that he was “not involved in drafting or approving statements for public use by the White House this past weekend on alleged Russian contacts.”

Whether there were such contacts remains a major point of contention. Beyond Flynn, the investigation has focused on other figures including Paul Manafort, Trump’s former campaign chairman, who had previously served as a paid political adviser to the Putin-backed president of Ukraine.

U.S. intelligence reports cite multiple contacts between members of Trump’s team and Russians with links to the Kremlin, during the campaign and afterward, according to officials who have seen them. Such reports were based on intercepted Russian communications and other sources, the officials said.
Nunes, who served as a member of Trump’s transition team, has resisted calls for his House committee to investigate alleged contacts between Trump associates and Russia. He said in an interview that after months of investigations, U.S. authorities have turned up no evidence of such contacts.

“They’ve looked, and it’s all a dead trail that leads me to believe no contact, not even pizza-
delivery-guy contact,” Nunes said, appearing to rule out even unwitting contact between Trump officials and Russian agents. Investigators, Nunes said, “don’t even have a lead.”

The Silence of the Hacks

The story so far: A foreign dictator intervened on behalf of a U.S. presidential candidate — and that candidate won. Close associates of the new president were in contact with the dictator’s espionage officials during the campaign, and his national security adviser was forced out over improper calls to that country’s ambassador — but not until the press reported it; the president learned about his actions weeks earlier, but took no action.

Meanwhile, the president seems oddly solicitous of the dictator’s interests, and rumors swirl about his personal financial connections to the country in question. Is there anything to those rumors? Nobody knows, in part because the president refuses to release his tax returns.

Maybe there’s nothing wrong here, and it’s all perfectly innocent. But if it’s not innocent, it’s very bad indeed. So what do Republicans in Congress, who have the power to investigate the situation, believe should be done?

Nothing.

Paul Ryan, the speaker of the House, says that Michael Flynn’s conversations with the Russian ambassador were “entirely appropriate.”

Devin Nunes, the chairman of the House Intelligence Committee, angrily dismissed calls for a select committee to investigate contacts during the campaign: “There is absolutely not going to be one.”
Jason Chaffetz, the chairman of the House oversight committee — who hounded Hillary Clinton endlessly over Benghazi — declared that the “situation has taken care of itself.”

Just the other day Republicans were hot in pursuit of potential scandal, and posed as ultrapatriots. Now they’re indifferent to actual subversion and the real possibility that we are being governed by people who take their cues from Moscow. Why?

Well, Senator Rand Paul explained it all: “We’ll never even get started with doing the things we need to do, like repealing Obamacare, if we’re spending our whole time having Republicans investigate Republicans.” Does anyone doubt that he was speaking for his whole party?

The point is that you can’t understand the mess we’re in without appreciating not just the potential corruption of the president, but the unmistakable corruption of his party — a party so intent on cutting taxes for the wealthy, deregulating banks and polluters and dismantling social programs that accepting foreign subversion is, apparently, a small price to pay.

Put it this way: I’ve been seeing comparisons between the emerging information on the Trump-Putin connection and the Watergate affair, which brought down a previous president. But while the potential scandal here is far worse than Watergate — Richard Nixon was sinister and scary, but nobody imagined that he might be taking instructions from a foreign power — it’s very hard to imagine today’s Republicans standing up for the Constitution the way their predecessors did.
 
It’s not simply that these days there are more moral midgets in Congress, although that, too. 

Watergate took place before Republicans began their long march to the political right, so Congress was far less polarized than it is now. There was widespread agreement between the parties on basic economic ideas, and a fair amount of ideological crossover; this meant that Republicans didn’t worry so much that holding a lawless president accountable would derail their hard-line agenda.

The polarization of the electorate also undermines Congress’s role as a check on the president: Most Republicans are in safe districts, where their main fear is of primary challengers to their right. And the Republican base has suddenly become remarkably pro-Russian. Funny how that works.
So how does this crisis end?

It’s not a constitutional crisis — yet. But Donald Trump is facing a clear crisis of legitimacy. His popular-vote-losing win was already suspect given the F.B.I.’s last-minute intervention on his behalf. Now we know that even as the F.B.I. was creating the false appearance of scandal around his opponent, it was sitting on evidence suggesting alarmingly close relations between Mr. Trump’s campaign and Russia. And nothing he has done since the inauguration allays fears that he is in effect a Putin puppet.

How can a leader under such a cloud send American soldiers to die? How can he be granted the right to shape the Supreme Court for a generation?

Again, a thorough, nonpartisan, unrestricted investigation could conceivably clear the air. But Republicans in Congress, who have the power to make such an investigation happen, are dead set against it.

The thing is, this nightmare could be ended by a handful of Republican legislators willing to make common cause with Democrats to demand the truth. And maybe there are enough people of conscience left in the G.O.P.

But there probably aren’t. And that’s a problem that’s even scarier than the Trump-Putin axis.

The Greatest Threat to Security Since WWII

NATO is in danger and the West is losing its cohesion. Lessons of the past warn us to stand tall against those seeking to unravel a global security framework that has kept us safe since World War II.

The United States and our international allies, which for so long has been the centerpiece of what is rightly called "The Free World," are facing the greatest threat to global stability since the end of World War II. Security arrangements, like the North Atlantic Treaty Organization (NATO), which for more than seven decades have kept us safe from yet another global conflict, are quickly coming unraveled. These are the deep concerns I am bringing to the Munich Security Conference.

Here in America, I see the erosion of our alliances caused by growing tensions across the world and fed by angry voices at home. These forces threaten the future of an international security framework that has long ensured the United States and its partner nations of a stable world and the free flow of ideas and trade. Hearing those voices, many here are second-guessing the alliances and relationships that have served us so well in the post-war era.

Too many of my countrymen prefer that we stay at home instead of support our longstanding allies. And in many of those allied nations, similar doubts are taking root.

A Secure and Stable World Order
 
Why am I alarmed, as an American state governor who is otherwise focused on domestic policies and the delivery of public services to 11.7 million Ohioans? It is because my state has been restoring our economy and creating jobs for Ohio workers by keeping pace with the demands and rewards of a global economy. A secure and stable world order, open to the free exchange of goods and technology, is essential to my state's well-being.

These are not new concerns for me, having served nine terms as a member of Congress, including 18 years on the U.S. House Armed Services Committee. From those perspectives I have feared this unraveling for some time, but my concerns are redoubled by the most recent threats to our alliances, both in the United States and abroad.

Why are these alliances essential for Ohio and for all of America? It's more than a matter of protecting our own borders and preserving our national identity, important as those goals may be. It's also about protecting the collective human values that have for so long sustained the United States -- values such as freedom of speech, universal respect for all without distinction as to race, sex, language or religion, and a world open to free enterprise, travel and trade.

These are the shared values that we and our allied nations believe in; the same values others scorn and deny to those they rule.

History Repeating
 
Through seven stressful decades since the end of World War II, these values and the moral standards they embrace have been the foundation of an international security framework, including NATO, which has helped us avoid global war and provided its partners widespread economic opportunity with free trade. The world has been down this road before, and it didn't end well. Twice before, on the eve of World War I and again in the dark days before World War II, we witnessed regional instability that quickly led to global conflict -- leaving tens of millions dead and large swaths of the world in ruin.


Now history threatens to repeat itself and we can see some of the same erosive forces at work: a weakening NATO and growing conflict in regions such as Georgia, Crimea and Eastern Ukraine.

Perennial tensions and bloody conflict in the Middle East are joined by gathering storm clouds in North Korea and the South China Sea -- and overhanging it all, international terrorism. Calls for disengagement, isolation and shuttered trade add to the sense that our world is coming undone.

Each of our allied nations is safer when freedom, democracy and the rule of law are embraced around the world. In places like Ukraine, there is a deep yearning for these values and we must encourage that desire, not dismiss it.

The notion that it somehow makes Americans safer at home to sacrifice support for a free Ukraine in exchange for a better relationship with Russia -- which continues to deny its unacceptable interference in our presidential election -- is wrong and naïve. It's inconsistent with our shared ideals and leads other allies to doubt American resolve. Putin only respects strength, which is one reason why I support tougher sanctions against Russia and Putin's inner circle.

We Won't Get a Second Chance
 
A further cause for concern is that our once-vigilant alliances have failed to deal with the most urgent issues facing them -- challenges such as the refugee crisis, secure borders, cybersecurity and intelligence sharing in the face of terrorism. We need to fix those weaknesses, but in ways that help our alliances evolve, not throwing away the underlying values that have held us together and kept the peace for so many decades.

Rather than allowing history to replay its sad lessons, now is the time for us to rediscover the spirit of unity and social solidarity we need to restore the functioning of our own democracies. We must also find in ourselves once again the courage to stand up for our values internationally -- the values on which our shared system of security was built and that have become too easy for us to take for granted.

History teaches that it takes courageous resolve to preserve the values-based alliances that have kept us safe for seven decades. Without a shared commitment to freedom, how can we expect it to survive?

That is why we must reassure the Baltics and Ukraine -- who live in the very shadow of Russia -- that the United States will be there for them if trouble arises. Russian intimidation of our NATO allies or other free nations cannot be tolerated.

Instead of listening to the siren song of false prophets, we must relearn to work together with respect for opposing points of views in a search for the common ground and a recommitment to shared values that will help us together reaffirm our common humanity.

The psychiatrist who wrote the definition of narcissistic personality disorder says Trump doesn't have it

Calling the president 'mentally ill' is an insult to people who have genuine conditions, says Professor Allen Frances

Donald Trump may be a “world-class narcissist”, but he does not display signs of having narcissistic personality disorder, according to the psychiatrist who wrote the criteria that defines the disorder.
Professor Allen Frances, the psychiatrist who wrote the defining clinical characteristics for narcissistic personality disorder (NPD) said the President does not meet them, and warned against labelling Mr Trump as “mentally ill”.

In a letter to the New York Times, Professor Frances said that such psychiatric name-calling “is a stigmatising insult to the mentally ill (who are mostly well behaved and well meaning) to be lumped with Mr. Trump (who is neither)”.

“He may be a world-class narcissist, but this doesn’t make him mentally ill, because he does not suffer from the distress and impairment required to diagnose mental disorder,” he said.
According to Psychology Today, to which Professor Frances contributes, NPD is indicated by five or more of the following symptoms:
  • Exaggerates own importance
  • Is preoccupied with fantasies of success, power, beauty, intelligence or ideal romance
  • Believes he or she is special and can only be understood by other special people or institutions
  • Requires constant attention and admiration from others
  • Has unreasonable expectations of favourable treatment
  • Takes advantage of others to reach his or her own goals
  • Disregards the feelings of others, lacks empathy
  • Is often envious of others or believes other people are envious of him or her
  • Shows arrogant behaviours and attitudes
Psychology Today notes that 50-75 per cent of the people diagnosed with narcissistic personality disorder are male.

It also warns that it is common for many adolescents to display the characteristics listed above but says “this does not indicate that they will later develop narcissistic personality disorder”.

Professor Frances, who is currently professor emeritus of psychiatry and behavioural sciences at Duke University Medical College, finished his letter with a withering verdict on Mr Trump’s cognitive impetuses and indicated that challenging the President’s mental health would be unproductive.

Time for Congress to Investigate Mr. Trump’s Ties to Russia



In history, this is where Congress steps in. During the Vietnam War, Watergate and the Iran-contra scandal, when a president’s actions or policies crossed the line, Congress investigated and held the White House to account. The time has come for it to do so again.

In the last week alone, Americans have witnessed the firing of President Trump’s national security adviser, Michael Flynn, and learned with shock and incredulity that members of Mr. Trump’s campaign and inner circle were in repeated contact with Russian intelligence officials.

Coming on top of credible information from America’s intelligence agencies that Russia tried to destabilize and influence the 2016 presidential campaign, these latest revelations are more than sufficient reason for Congress to investigate what Moscow has been up to and whether people at the highest levels of the United States government have aided and abetted the interests of a nation that has tried to thwart American foreign policy since the Cold War.

Given that context, one might expect Mr. Trump to be clamoring for details that would eliminate any suspicion that his administration is in league with an enemy. Instead he has waged an unhinged attack on the intelligence agencies themselves, praising President Vladimir Putin of Russia at every turn and pointing fingers everywhere but at himself, while refusing to take a single step to resolve questions about his administration’s ties to Russia.

Hence the urgent need for high-level congressional intervention. The ideal vehicle would be an investigative committee of senior senators from both parties as well as members of the House. Some Senate Republicans are beginning to step up. Senator Richard Burr, chairman of the Senate Intelligence Committee, has already said his committee will investigate the election hacking. Chuck Grassley, chairman of the Senate Judiciary Committee, and Dianne Feinstein, the panel’s top-ranking Democrat, are asking for a briefing and transcripts of Mr. Flynn’s calls to the Russian ambassador.

Senators John McCain, Lindsey Graham and Pat Roberts favor a broader investigation. John Cornyn, the Senate majority whip, has also raised the possibility of an investigation by Senate committees with jurisdiction over the intelligence community.

The Democrats would obviously be on board — Chuck Schumer, the Senate Democratic leader, has also called for the Senate Intelligence Committee to lead a bipartisan inquiry. The person who needs to make this happen is Mitch McConnell, the Senate majority leader. Whatever form the committee takes, as Mr. Schumer said on Wednesday, all members must be granted equal access to “intelligence officials, transcripts and documents that they need to answer critical questions, and they must be permitted to make their findings public to the maximum extent possible.”

Admittedly, this is hoping for a lot from a Republican leadership whose natural inclination is to protect the president. This week, for instance, congressional Republicans closed off one avenue to forcing the release of Mr. Trump’s tax returns, which he has refused to divulge and which could help prove to Americans that he is not indebted to Russian financial entities. (It bears repeating, in this regard, that Mr. Trump didn’t fire Mr. Flynn this week for chummily discussing American sanctions on Russia with Moscow’s ambassador, or for lying about it. Mr. Trump knew all that for weeks. He fired Mr. Flynn after both of them got caught.)

With or without the administration’s cooperation, Congress’s plain and urgent duty, lest it be judged complicit, is to get to the bottom of this crisis.

Trump knew for weeks that aide was being misleading over Russia: White House

U.S. President Donald Trump knew for weeks that national security adviser Michael Flynn had misled the White House about his contacts with Russia but did not immediately force him out, an administration spokesman said on Tuesday.

Trump was informed in late January that Flynn had not told Vice President Mike Pence the whole truth about conversations he had before Trump took office with Russia's ambassador to the United States, White House spokesman Sean Spicer said.

Pence learned of the "incomplete information" that he received from Flynn when news reports surfaced late last week, spokesman Mark Lotter said on Tuesday.

Flynn quit on Monday after Trump asked for his resignation, and the president hopes to pick a new national security adviser by the end of the week, Spicer said.

The departure was another disruption for an administration already repeatedly distracted by miscues and internal dramas since the Republican businessman assumed the presidency on Jan. 20.

The New York Times reported late on Tuesday that members of Trump's campaign and other associates had contact with senior Russian intelligence officials in the year before the Nov. 8 presidential election, although U.S. officials told the newspaper they had not uncovered any evidence that Trump's associates colluded to disrupt the election.

U.S. lawmakers, including some leading Republicans, called for a deeper inquiry into not just Flynn's actions but broader White House ties to Russia. Trump has long said that he would like improved relations with Russian President Vladimir Putin.

Representative Adam Schiff, the top Democrat on the House of Representatives Intelligence Committee, said Trump only moved against Flynn because of news media attention, not concern about any wrongdoing.

"The reason they lost faith or trust in General Flynn only last night when they knew for weeks that he had been lying was that it became public," Schiff told MSNBC.

A timeline of events outlined by Spicer and a U.S. official showed that Trump had known for weeks about Flynn misleading the vice president.

Trump, a former reality TV star whose catchphrase was "You're fired!" has often boasted of his eagerness to get rid of subordinates. He was not quick to fire Flynn, a strong advocate of a better relations with Russia and a hard line against Islamist militants.

The Justice Department warned the White House in late January that Flynn had misled Pence by denying to him that he had discussed U.S. sanctions on Russia with Ambassador Sergei Kislyak, a potentially illegal act, a U.S. official said.

Flynn did talk about sanctions with the diplomat, whose calls were recorded by U.S. intelligence officials, the official said. But Pence went on television in mid-January and denied that Flynn had discussed sanctions.

The Federal Bureau of Investigation interviewed Flynn in his early days as Trump's national security adviser regarding his conversations with the Russian ambassador, a White House official confirmed.
Spicer stressed that the administration believed there was no legal problem with Flynn's conversations with Kislyak, but rather an issue over the president's trust in his adviser.

The turning point, Spicer said, was a Washington Post story published on Thursday in which Flynn, through a spokesman, said for the first time he could not say with 100 percent certainty that he had not discussed sanctions with Kislyak.

Spicer said the Justice Department sought to notify the White House counsel on Jan. 26 about the discrepancies in Flynn's accounts.


"The White House counsel informed the president immediately. The president asked them to commit a review of whether there was a legal situation there," Spicer told reporters, saying it was a "trust issue."

Flynn's conversations with the ambassador took place around the time that then-President Barack Obama imposed sanctions on Russia, charging that Moscow had used cyber attacks to try to influence the 2016 presidential election in Trump's favor.

A U.S. official familiar with the transcripts of the calls with the ambassador said Flynn indicated that if Russia did not retaliate in kind for Obama's Dec. 29 order expelling 35 Russian suspected spies and sanctioning Russian spy agencies, that could smooth the way toward a broader discussion of improving U.S.-Russian relations once Trump took power.

LEGAL FALLOUT?

Flynn's discussions with the Russian diplomat could potentially have been in violation of a law known as the Logan Act, which bans private citizens from negotiating with foreign governments about disputes or controversies with the United States. There have been no modern prosecutions using the 1799 law.

"The Logan Act is a red herring. The better question is whether he made any false statements to the FBI at any point, which would be a much bigger deal," said University of Texas law professor Stephen Vladeck, adding the fallout would likely be "political" in nature.

Flynn could also face legal trouble if it emerges that he violated other federal laws in his communications with the Russians, said Andrew Kent, a professor at Fordham University School of Law in New York. The Espionage Act criminalizes sharing information with foreign governments.
Democrats, who do not have control of Congress, clamored for probes into Flynn, and asked how much Trump knew about his connections to Russia.

U.S. Senate Democratic leader Chuck Schumer called for an investigation of potential criminal violations surrounding the resignation of Flynn.

"What I am calling for is an independent investigation with executive authority to pursue potential criminal actions," Schumer told reporters, saying such a probe could not be led by newly installed U.S. Attorney General Jeff Sessions or White House lawyers.

Two leading Senate Republicans, Bob Corker and John Cornyn, said the Intelligence Committee should investigate Flynn's contacts with Russia.

But the highest-ranking Republican in Congress, House of Representatives Speaker Paul Ryan, sidestepped questions about whether lawmakers should look into Flynn's Russia ties, saying he would leave it to the Trump administration to explain the circumstances behind Flynn's departure.
A broader investigation of the White House and its ties to Russia is not possible without the cooperation either of the Justice Department or the Republican-led Congress.

Russia's aggression in Ukraine and Syria and Republican congressional opposition to removing sanctions on Russia make any White House attempt to embrace Putin problematic.

Senator John McCain, a leading Republican voice on foreign relations, said Flynn's resignation raised questions about the administration’s intentions toward Putin’s Russia.

Flynn departure erupts into a full-blown crisis for the Trump White House



President Trump’s ouster of national security adviser Michael T. Flynn, and the circumstances leading up to it, have quickly become a major crisis for the fledgling administration, forcing the White House on the defensive and precipitating the first significant breach in relations between Trump and an increasingly restive Republican Congress.

Even as the White House described Trump’s “immediate, decisive” action in demanding ­Flynn’s resignation late Monday as the end of an unfortunate episode, senior GOP lawmakers were buckling under growing pressure to investigate it.

Senate Majority Leader Mitch McConnell (R-Ky.) said Tuesday that it was “highly likely” that the events leading to Flynn’s departure would be added to a broader probe into Russian meddling in the U.S. presidential election. Intercepts showed that Flynn discussed U.S. sanctions in a phone call with the Russian ambassador — a conversation topic that Flynn first denied and then later said he could not recall.

McConnell’s comments followed White House revelations that Trump was aware “for weeks” that Flynn had misled Vice President Pence and others about the content of his late-December talks with Russian Ambassador Sergey Kislyak.

White House counsel Donald F. McGahn told Trump in a briefing late last month that Flynn, despite his claims to the contrary, had discussed U.S. sanctions imposed on Russia by the Obama administration in late December, press secretary Sean Spicer said Tuesday. That briefing, he said, came “immediately” after Sally Q. Yates, then the acting attorney general, informed McGahn on Jan. 26 about discrepancies between intercepts of Kislyak’s phone calls and public statements by Pence and others that there had been no discussion of sanctions.



Trump brought in senior strategist Stephen K. Bannon and White House Chief of Staff Reince Priebus to join the discussion with McGahn, according to two officials familiar with the conversations who spoke on the condition of anonymity because they were not authorized to speak publicly.

McGahn then conferred with Yates again the following day, Jan. 27, to try to glean more information, these two officials said. Within the White House, the matter was viewed skeptically, and Trump, Bannon, Priebus and McGahn for several days remained among the few people briefed, they said.

Over the next two weeks, the officials said, Flynn was asked multiple times about what exactly he had said. He brushed aside the suggestion that he had spoken about sanctions with the ambassador — denials that kept him afloat within the White House even as he was being actively evaluated, they said.

It was not until a Washington Post report last Thursday, in which Flynn was quoted as saying that he had no “recollection” of discussing sanctions but couldn’t be sure that he hadn’t, that the downward slide culminating in Monday’s forced resignation began, several administration officials said.
“We’ve been reviewing and evaluating this issue with respect to General Flynn on a daily basis for a few weeks, trying to ascertain the truth,” Spicer said at the daily White House press briefing. He emphasized that an internal White House inquiry had concluded that nothing Flynn discussed with the Russian was illegal but that he had “broken trust” with Trump by not telling the truth about the talks.

When asked whether Trump told Flynn to talk to Kislyak about sanctions, Spicer responded: “No, absolutely not.”

Asked why Trump had waited nearly three weeks to act after what Spicer called a “heads-up” from the Justice Department, he said that once the question of legality was settled, “then it became a phase of determining whether or not [Flynn’s] action on this and a whole host of other issues undermined” Trump’s trust. He declined to specify the “other issues.”



In an interview conducted early Monday and published Tuesday by the Daily Caller, Flynn said that he did not specifically discuss sanctions with Kislyak but rather President Barack Obama’s simultaneous expulsion of 35 Russian diplomats. He said he told the ambassador that “we’ll review everything” following Trump’s inauguration.

Current and former U.S. officials have said, however, that much of the conversation was about sanctions and that Flynn suggested that Moscow not respond in kind to the expulsions — advice that Russian President Vladi­mir Putin took in declining to take retaliatory action.

Although Trump has not publicly mentioned his view of the sanctions, Spicer said that the president “has made it very clear he expects the Russian government to de-escalate violence in the Ukraine and return Crimea,” even as he hopes to cooperate with Putin on terrorism.
Asked Tuesday on a flight to Brussels about Flynn’s ouster, Defense Secretary Jim Mattis said it “has no impact” on his job. “It doesn’t change my message at all, and who is on the president’s staff is who I will work with,” he said.

Mattis was on his way to a meeting of NATO defense ministers, who were expected to discuss their significant concerns about Russian aggression. During his confirmation hearing, Mattis placed Russia first among threats to U.S. security.

Officials inside the National Security Council described low morale and concern about the future. The “worthless” message at a five-minute staff meeting Tuesday morning, one official said, was: “Keep working hard. Don’t leave.”

For those who knew and liked Flynn, another official said, “it’s sad. He’s a good man, and I hate to see this.”

Various accounts of the Flynn saga offered by White House officials in recent days have added to confusion about how the administration viewed Flynn’s actions, who knew what and when they knew it.

News accounts about a Flynn-Kislyak conversation in late December — the day before Obama announced new sanctions related to Russian election interference — first surfaced in a David Ignatius column in The Post on Jan. 12. Asked the next day whether they had talked about the sanctions in light of Trump’s campaign and post-election pledges to better relations with Russia, White House officials said the subject had not been discussed.

Three days later, Pence told CBS’s “Face the Nation” that Flynn had assured him personally that there was no conversation about sanctions. Spicer offered similar assurances in a subsequent White House briefing.

On Jan. 24 or 25, based on discrepancies between comments by Pence and Spicer and what they knew from regular intercepts of Kislyak’s calls, FBI agents interviewed Flynn. Details of that interview, first reported Tuesday by the New York Times, are unknown but they could expose Flynn to possible charges if he denied that he had discussed sanctions with Kislyak. That interview was followed by the Justice notice to McGahn, who immediately informed Trump and others, officials said.

After Trump ordered McGahn to review the matter, Spicer said, he quickly concluded that the president’s “instinctive” conclusion that the discussions were not illegal was correct. But some in the White House who had long distrusted Flynn began to contemplate his departure. CIA Director Mike Pompeo and Keith Kellogg, the National Security Council chief of staff, began attending intelligence briefings with Flynn.

“The president was sort of like: Until this matter is sorted out, I want buttressing,” said the senior official, one of several who discussed the sensitive matter on the condition of anonymity. “The idea was . . . if the president decides to pull the trigger, we need to make sure that we have some options.”
Flynn was eventually made aware of the White House investigation, which led to alarm among senior Trump aides when he initially told The Post, in a Feb. 8 interview, that there had been no discussion about sanctions. He revised his remarks to the paper the next day, saying through a spokesman that “while he had no recollection of discussing sanctions, he couldn’t be certain that the topic never came up.”

The two accounts were published by The Post on the evening of Feb. 9.

“His story remained the same until that night,” Spicer told reporters in his office Tuesday evening. “There was a story in The Post where there’s a White House official that says that he could not recall. . . . Whatever that quote was is what matters. . . . His story remained the same until that night.”
Pence spokesman Marc Lotter told reporters that the vice president first became aware of the “incomplete information” Spicer had provided him by reading the same newspaper account.
Flynn was then questioned by McGahn, Pence and Priebus, who the official said was so frustrated that his tone became more that of a litigator than a colleague.

Asked Friday aboard Air Force One about the Post reporting that Flynn allegedly had not told the truth about the calls, Trump said he was not familiar with it.

“I don’t know about that. I haven’t seen it. What report is that? I haven’t seen that. I’ll look into that,” Trump told reporters on the plane.

Spicer said Tuesday that Trump was responding only to a question about the Post report and was not speaking about the overall issue of Flynn’s contact with the Russian ambassador and his discussion of sanctions.

After discussing the situation throughout the weekend at Trump’s Florida resort, a final decision was made Monday night by Trump, along with Priebus and senior advisers Bannon and Jared Kushner, to tell Flynn to resign, officials said.

That is a notably different version of events than the one offered Monday night, when administration officials characterized Flynn’s departure as voluntary. One senior White House official said Monday that Trump had not fired Flynn but that he had made the decision to resign on his own because of “the cumulative effect” of damaging news coverage.






The Leakers Who Exposed Gen. Flynn’s Lie Committed Serious — and Wholly Justified — Felonies

President Trump’s national security adviser, Gen. Michael Flynn, was forced to resign on Monday night as a result of getting caught lying about whether he discussed sanctions in a December telephone call with a Russian diplomat. The only reason the public learned about Flynn’s lie is because someone inside the U.S. government violated the criminal law by leaking the contents of Flynn’s intercepted communications.

In the spectrum of crimes involving the leaking of classified information, publicly revealing the contents of SIGINT — signals intelligence — is one of the most serious felonies. Journalists (and all other nongovernmental citizens) can be prosecuted under federal law for disclosing classified information only under the narrowest circumstances; reflecting how serious SIGINT is considered to be, one of those circumstances includes leaking the contents of intercepted communications, as defined this way by 18 § 798 of the U.S. Code:

Whoever knowingly and willfully communicates … or otherwise makes available to an unauthorized person, or publishes … any classified information … obtained by the processes of communication intelligence from the communications of any foreign government … shall be fined under this title or imprisoned not more than ten years, or both.

That Flynn lied about what he said to Russian Ambassador Sergey Kislyak was first revealed by Washington Post columnist David Ignatius, who has built his career on repeating what his CIA sources tell him. In his January 12 column, Ignatius wrote: “According to a senior U.S. government official, Flynn phoned Russian Ambassador Sergey Kislyak several times on Dec. 29, the day the Obama administration announced the expulsion of 35 Russian officials as well as other measures in retaliation for the hacking.”

That “senior U.S. government official” committed a serious felony by leaking to Ignatius the communication activities of Flynn. Similar and even more extreme crimes were committed by what the Washington Post called “nine current and former officials, who were in senior positions at multiple agencies at the time of the calls,” who told the paper for its February 9 article that “Flynn privately discussed U.S. sanctions against Russia with that country’s ambassador to the United States during the month before President Trump took office, contrary to public assertions by Trump officials.” The New York Times, also citing anonymous U.S. officials, provided even more details about the contents of Flynn’s telephone calls.

That all of these officials committed major crimes can hardly be disputed. In January, CNN reported that Flynn’s calls with the Russians “were captured by routine U.S. eavesdropping targeting the Russian diplomats.” That means that the contents of those calls were “obtained by the processes of communication intelligence from the communications of [a] foreign government,” which in turn means that anyone who discloses them — or reports them to the public — is guilty of a felony under the statute.

Yet very few people are calling for a criminal investigation or the prosecution of these leakers, nor demanding the leakers step forward and “face the music” — for very good reason: The officials leaking this information acted justifiably, despite the fact that they violated the law. That’s because the leaks revealed that a high government official, Gen. Flynn, blatantly lied to the public about a material matter — his conversations with Russian diplomats — and the public has the absolute right to know this.

This episode underscores a critical point: The mere fact that an act is illegal does not mean it is unjust or even deserving of punishment. Oftentimes, the most just acts are precisely the ones that the law prohibits.

That’s particularly true of whistleblowers — i.e., those who reveal information the law makes it a crime to reveal, when doing so is the only way to demonstrate to the public that powerful officials are acting wrongfully or deceitfully. In those cases, we should cheer those who do it even though they are undertaking exactly those actions that the criminal law prohibits.

This Flynn episode underscores another critical point: The motives of leakers are irrelevant. It’s very possible — indeed, likely — that the leakers here were not acting with benevolent motives. Nobody with a straight face can claim that lying to the public is regarded in official Washington as some sort of mortal sin; if anything, the contrary is true: It’s seen as a job requirement.

Moreover, Gen. Flynn has many enemies throughout the intelligence and defense community. The same is true, of course, of Donald Trump; recall that just a few weeks ago, Democratic Sen. Chuck Schumer warned Trump that he was being “really dumb” to criticize the intelligence community because “they have six ways from Sunday at getting back at you.”

It’s very possible — I’d say likely — that the motive here was vindictive rather than noble. Whatever else is true, this is a case where the intelligence community, through strategic (and illegal) leaks, destroyed one of its primary adversaries in the Trump White House.

But no matter. What matters is not the motive of the leaker but the effects of the leak. Any leak that results in the exposure of high-level wrongdoing — as this one did — should be praised, not scorned and punished.

It is, of course, bizarre to watch this principle now so widely celebrated. Over the last eight years, President Obama implemented the most vindictive and aggressive war on whistleblowers in all of U.S. history. As Leonard Downie, one of the editors at the Washington Post during the Watergate investigation, put it in a special report: “The [Obama] administration’s war on leaks and other efforts to control information are the most aggressive I’ve seen since the Nixon administration.”



It’s hard to put into words how strange it is to watch the very same people — from both parties, across the ideological spectrum — who called for the heads of Edward Snowden, Chelsea Manning, Tom Drake, and so many other Obama-era leakers today heap praise on those who leaked the highly sensitive, classified SIGINT information that brought down Gen. Flynn.

It’s even more surreal to watch Democrats act as though lying to the public is some grave firing offense when President Obama’s top national security official, James Clapper, got caught red-handed not only lying to the public but also to Congress — about a domestic surveillance program that courts ruled was illegal. And despite the fact that lying to Congress is a felony, he kept his job until the very last day of the Obama presidency.
But this is how political power and the addled partisan brain in D.C. functions. Those in power always regard leaks as a heinous crime, while those out of power regard them as a noble act. They seamlessly shift sides as their position in D.C. changes.

Indeed, while Democrats have suddenly re-discovered the virtues of illegal leaking, Trump-supporting Republicans are insisting that the only thing that matters is rooting out the criminal leakers. Fox News host Steve Doocey and right-wing radio host Laura Ingraham today both demanded to know why the leakers weren’t being hunted, while congressional Republicans are vowing investigations to find the leakers. And Trump himself today — echoing Obama-era Democrats — said that “the real story” isn’t the lies told by his national security adviser but rather the fact that someone leaked information exposing them:

The real story here is why are there so many illegal leaks coming out of Washington? Will these leaks be happening as I deal on N.Korea etc?

But this is just the tawdry, craven game of Washington. People with no actual beliefs shamelessly take diametrically opposite views on fundamental political questions based exclusively on whether it helps or hurts their leaders. Thus, the very same Democrats who just three months ago viewed illegal leaking as a grave sin today view it as an act of heroic #Resistance.

What matters far more than this lowly and empty game-playing is the principle that is so vividly apparent here. Given the extreme secrecy powers that have arisen under the war on terror, one of the very few ways that the public has left for learning about what its government officials do is illegal leaking. As Trevor Timm notes, numerous leaks have already achieved great good in the three short weeks that Trump has been president.

Leaks are illegal and hated by those in power (and their followers) precisely because political officials want to hide evidence of their own wrongdoing, and want to be able to lie to the public with impunity and without detection. That’s the same reason the rest of us should celebrate such illegal leaks and protect those who undertake them, often at great risk to their own interests, so that we can be informed about the real actions of those who wield the greatest power. That principle does not change based upon which political party controls the White House.

As Tensions Rise, Steve Bannon and ISIS Get Closer to Their Common Goal: Civilizational War

The Trump administration has taken sweeping, drastic measures that it says are necessary to protect Americans from the threat of terrorism, including its executive order halting immigration from seven Muslim-majority countries. But the radical policies and beliefs of this administration could just as easily end up fueling the narratives of extremist groups fighting the United States. When Trump ran a campaign built on promises to destroy ISIS, how can one explain the fact that supporters of the group in Mosul were reportedly celebrating his Muslim ban?

The order was based on plainly dubious claims about national security, targeting for scrutiny some of the most heavily vetted visitors to the United States. But the tangible purpose it did serve, before being at least temporarily frozen by the courts, was to divide Americans from millions of people in the Muslim world by sending the latter a message of gratuitous insult and contempt — and emboldening the very extremist movements the order was ostensibly directed against.

That kind of polarization may be exactly what some members of the White House want.

High-ranking members of the current administration — most notably its chief strategist, Steve Bannon — have publicly espoused apocalyptic theories of history that center on a forthcoming clash between Western countries and the Muslim world, a conflict that many of them seem to perceive as both inevitable and desirable.

There are striking parallels between Bannon’s worldview and the perspective of terrorist groups like the Islamic State, which see the world divided in similarly binary terms — hence their reported enthusiasm for the executive order that Bannon helped author.

A proponent of pseudoscientific theories of history like the “Fourth Turning,” Bannon has predicted the coming of another major U.S. war in the Middle East and a military conflict with what he calls an “expansionist China.” In interviews during the election campaign, Bannon openly described Trump as a “blunt instrument” for his ideological goals.

A 2014 speech that Bannon delivered to an audience at the Vatican provides a hint of what kind of program he might want to use Trump to achieve. In that address, delivered via teleconference, Bannon called for a revival of the tradition of the “church militant,” describing a vague yet apocalyptic threat he claims that Western countries face from both “Islamic jihadist fascism” and their own loss of religious faith.
We’re at the very beginning stages of a very brutal and bloody conflict … to fight for our beliefs against this new barbarity that’s starting, that will completely eradicate everything that we’ve been bequeathed over the last 2,000, 2,500 years.
Now consider how Bannon’s hysterical view of history was echoed that same year in a speech by Islamic State leader Abu Bakr al-Baghdadi, who issued a similarly vague, yet no less frenzied call to arms:
So let the world know that we are living today in a new era. Whoever was heedless must now be alert. Whoever was sleeping must now awaken. … You will face tribulation and fierce battle. … So prepare your arms, and supply yourselves with piety.
Nowhere are these types of ideas particularly popular. While the Islamic State is held up by anti-Muslim activists in the United States as the quintessential expression of Muslim beliefs, in reality the group is deeply loathed in Muslim-majority countries. In the United States, though Trump won the election, his voter base comprised a distinct minority of the electorate. Even among those who did vote for him, few appear to have done so in enthusiasm for the apocalyptic theories of history held by advisers like Bannon. Huge numbers of people have also taken to the streets in opposition to Trump’s executive orders, which has helped to counteract the administration’s anti-Muslim message to the world, showing that it does not represent the views of all Americans.
But it doesn’t take much for a highly motivated minority to spark a broader conflict.

ISIS attacks have been deliberately calibrated to shock and offend the sensibilities of Western publics, a strategy that the group openly refers to as “eliminating the grayzone” of coexistence between societies. Many 19th- and 20th-century revolutionary movements were also led by small, militant vanguards that used violence and provocation to help advance their political programs. In their time, these movements achieved real tactical successes. And even today, despite widespread public war-weariness in the United States, ISIS has accomplished its goal of dragging American troops back into armed conflicts in Iraq and Syria that show little sign of abating.

After a series of improbable successes, the radical right-wing vanguard of U.S. politics has now taken control of the government, along with the most powerful military on the planet. In its enthusiasm for civilizational war, it is just the enemy that a group like the Islamic State needs to help validate its desperate and fanatical narrative.

An early example of the kind of harm that the Trump administration can do came in the form of the first special operations forces raid authorized by Trump after his inauguration. In that operation — reportedly promoted to him over dinner with his advisers — a total of 25 civilians were reportedly killed, including nine children under the age of 13. Among those killed was an 8-year-old U.S.

citizen, Nawar al-Awlaki, the daughter of deceased al Qaeda proselytizer Anwar al-Awlaki. Images of Awlaki’s daughter and other victims of the raid were broadcast around the world, fueling widespread outrage.

Days later, the Yemeni branch of al Qaeda publicly denounced Trump for carrying out a “massacre” of civilians. The group promised vengeance, saying that global outrage over the deaths meant that “the flame of jihad has ignited and reached all over the world.”

While that may be an overstatement, it is not hard to see how a cycle of tit-for-tat violence, already tacitly established since the start of the war on terror, could accelerate dramatically under an administration that actively seeks to escalate conflict. Where President Obama sought to calm public fears in the aftermath of ISIS attacks, Trump and his administration will undoubtedly seek to inflame them for political gain. It’s only a matter of time before such an attack occurs, and Trump’s reaction could have consequences that quickly spiral out of control.

In his memoirs, published after his suicide in 1942, the exiled Austrian Jewish writer Stefan Zweig described his feelings of despair upon realizing that a “tiny but loud-mouthed party of German Nationalists” had succeeded in seizing power and dragging humanity into a global conflict it had neither wanted or expected. “The personal cause to which I had lent the force of my convictions, the peaceful union of Europe, had been wrecked,” Zweig lamented. “What I feared more than my own death, war waged by everyone against everyone else, had been unleashed for the second time.”

Seven decades after Zweig penned these words, small, well-organized groups of right-wing radicals are once again ascendant across the world. The best hope to stop them may be the popular opposition movements that have begun to stir in the United States. But most importantly, it will take a rejection of the logic of revenge and collective blame on both sides to prevent the apocalyptic visions of extremists from becoming reality.
